Senate Bill 863 required all liens claimants to pay a lien activation fee. SB 863 also required liens filed prior to the effective date of SB 863 to pay an activation fee of $100. This activation fee was meant as a disincentive to file frivolous liens, aimed to address the lien crisis and growing backlogs of liens in the workers’ compensation system.

Paper QME panel requests are now a thing of the past. Panel requests are going online. September 3, 2015 was the last day to submit a panel request by paper. After the short hiatus, form 106 will be available online starting at 8 a.m. on October 1, 2015.
Under the new online Panel system, all initial panel requests for represented cases must be submitted online. The process for unrepresented cases remain unchanged.
Any of us who appear at the various boards of the WCAB have seen the computer work- stations specifically installed for injured workers to apply for payments from the $120 million fund created by SB 863. Workers can apply via these kiosks or online at the Department of Industrial Relations website.
The application process started Monday April 13th with determinations expected to take 60 days. If accepted an injured worker would be given a one-time payment of $5,000 from the Return-to-Work program.
